1: Preamble

Success in cooperation often depends on whether the cooperation partners share common values, live up to the law and create an open climate so that difficult issues can be addressed and existing risks minimized.
The HACK-CMP team informs, sensitizes and supports the companies and self-employed persons involved in a cooperation project in terms of the values, obligations and assurances mentioned in this Code of Conduct (CoC) and thereby contributes to the creation of a climate of trust.
The following Code of Conduct serves as a basis for a respectful and cooperative collaboration of partners who are striving for cooperation within the HACK-CMP Team and for the HACK-CMP Team between themselves. The essential principles and basic rules of the parties involved in a cooperation are hereby summarized. The CoC offers thereby an orientation framework to all partners to topics such as regularity & Compliance, fairness & equal treatment, confidentiality and data protection and much more.
Due to the COVID-19 crisis and the consequences connected with it the HACK-CMP team is ready to forgo any renumerations achieved for the good public welfare. This is a great and commendable act. However, the developed solutions and principles are also applicable for other crisis situations. If a marketing option of the solution should arise or funds can be acquired, the resulting proceeds are to be divided fairly among the participants. The criteria for this are to be defined jointly.

2: Principles of Conduct

Legal compliance

We regard compliance with national and international laws and internal regulations as a fundamental principle of economically responsible action. We always observe the applicable legal prohibitions and obligations.

Data protection and information security

The protection of personal data in general, but especially of data of employees, partners, customers and suppliers, is of great importance to us. We pay attention to data security, transparency and data minimization.
The cooperation partners ensure that personal data exchanged within the cooperation is subject to the same high standards of data security and data protection. Each partner ensures that the legally required level of data protection is adhered to in his company.

Human and labour rights

We respect internationally recognised human rights, human dignity and personal rights and support their observance. We strictly reject all forms of forced and child labour.

Equal treatment and non-discrimination

In our cooperation we live a culture of equal opportunities, mutual trust and respect. We promote equal opportunity, tolerance and dignified, polite and honest dealings with each other, and forbid any form of discrimination.

Intellectual property and know-how

We respect trade secrets, intellectual property, know-how and other rights to intangible assets of our partners and in the HACK-CMP team between each other. At the same time, we share our knowledge and expertise openly with each other in order to develop and implement new ideas together.

Interfaces

As far as possible, we commit ourselves to use open source components for the networking of the software solutions involved in the cooperation.
The use of the data exchange objects and methods defined therein ensures the reusability of interface implementations and thus accelerates the development of networked software solutions.

Money Laundering Prevention

Each cooperation partner and the cooperation itself must comply with money laundering law. No partner should participate in money laundering activities.

Public appearance and communication

We respect the right to freedom of expression and the protection of personal rights and privacy. We and our employees pay attention to the reputation and standing of individual team members, companies and the entire cooperation when appearing in public, especially in front of the media.

Confidential company information

We take the necessary steps to protect confidential information and business documents from access and inspection by third parties.

Public Relations

The HACK-CMP team will make its findings and results public. The publications will inform about successful cooperation (e.g. Best Practices) to show further companies, research institutions and freelancers the chances and advantages of cooperation. All companies, research institutions or freelancers involved in an (ongoing) cooperation allow the HACK-CMP team to publish such publications, which are related to the cooperation.

3: Breaches of the Code of Conduct

In case of violation of the rules within this Code of Conduct, the team member is requested to immediately stop the violation. If the team member does not stop or repeat the violation, the team member will be excluded from the HACK-CMP Team. A claim for compensation for services previously provided by the member does not exist.
If a team member should offend against the basic principles of this Code of Conduct regulated under number 2, the team member is immediately excluded from the HACK-CMP team. Notification obligations in case of criminal offences as well as liability claims will be checked and if necessary legally enforced.
A duty of secrecy about the project HACK-CMP and associated knowledge obtained during project tenure will exist for the excluded member for the duration of 5 years after exclusion.

4: Closing Words

We promote an active and open communication of this Code of Conduct as well as the values, rules and standards underlying this Code of Conduct between all cooperation partners within the HACK-CMP project. Each cooperation partner is responsible for the implementation of the Code of Conduct in their own company or applies it for themselves.
All cooperation partners must be measured by this Code of Conduct because of their role model function. They ensure that all parties involved know, understand and apply the Code of Conduct and are the first contact persons for questions regarding the understanding or interpretation of individual regulations.
